Gilyard, 27, of Passaic, worked as a customer service manager in the Garfield store from November 2016 until she was fired in May, according to the whistleblower suit filed in Superior Court of Bergen County.Shortly after the pandemic began, Walmart instituted policies based on recommendations from the Center for Disease Control and Prevention, states the lawsuit, which was filed July 27.Walmart’s public health guidelines specified that no more than five customers for each 1,000 square feet of store space, roughly 20 percent of capacity, were allowed in the store at any time, according to the lawsuit.Gilyard states in the suit that she and other employers were instructed that no more than 428 customers plus employees were allowed in the store at any given time.But on May 2, Gilyard was approached by workers and customers «with safety concerns and complaints about the number of people in the store, and the failure to follow social distancing guidelines,» the suit states.Gilyard claims she brought the concerns to the store’s managers but the number of patrons in the store «escalated throughout the day.»Fearing «for the safety of the customers and employees in the store,» Gilyard contacted the Garfield Police Department and complained of the failure of the store to follow social distancing protocols, the suit states.Police officers came to the store but left without speaking to workers or those who had expressed concern about social distancing, the lawsuit says.After officers left, the managers asked her if she knew anything about the police complaint. Gilyard reiterated to them that the store was over capacity and in violation of public health and company guidelines of social distancing, the suit states.The suit states that Gilyard’s employment was terminated a few days later after she complained to managers that an irate customer was not adhering to social distancing practices.The suit accuses Walmart managers of violating the state’s Conscientious Employee Protection Act by firing her out of retaliation because she complained about violations of a public health mandate on social distancing.
